% 29.11.2019 Vide the present petition, the petitioner prays as follows: (a)call for and peruse the records of the case titled as "Bimla Devi Baid Trust Fund Vs. Jagat Overseas & Ors." bearing CC no. 17590/2016 pending in the court of Sh. Mohit Sharma, Ld. MM01, West, Tis Hazari Courts, Delhi, which is fixed for hearing on 17.10.2019;

(b)set aside the impugned order dated 03.09.2019 passed by Sh. Mohit Sharma, Ld. MM-01, West, Tis Hazari Courts, Delhi, in case titled as "Bimla Devi Baid Trust Fund Vs. Jagat Overseas &Ors." bearing CC no. 17590/2016;

Learned counsel on behalf of the respondent, on instructions from the authorised representative of the respondent, who is personally present in

court, has agreed that only one opportunity may be granted to the petitioner to cross examine the representative of the respondent, Rakesh Kumar. Accordingly, Trial Court is directed to give one opportunity to the petitioner to cross examine the respondent.

I hereby make it clear that the petitioner shall cross examine the aforesaid witness in all four cases pending before the Trial Court. In view of above, the petition is disposed of. Pending application also stands disposed of.
