The petitioner has filed the present petition seeking anticipatory bail in connection with FIR No. 129/2019, under Sections 448/452/380/323/34 of the Indian Penal Code, 1860, registered at P.S. Budh Vihar, Delhi. 4.

It is seen that the petitioner was granted anticipatory bail by an order dated 02.07.2019 by the learned ASJ-04/NW/Rohini/Delhi and was directed to join the investigation as and when required by the concerned Investigating Officer (IO). It is clear from the record that the petitioner has failed to cooperate with the IO and did not join the investigation as required. It is the

petitioner's case that he had gone to Haridwar. 5.

Although the petitioner's conduct does not warrant any indulgence from this Court, however, considering the allegations made, this Court is of the view that the petitioner ought not to be taken into custody and should be given one more chance to cooperate with the IO. 6.

Accordingly, the petitioner is granted anticipatory bail subject to him furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount to the satisfaction of the IO. The petitioner shall appear before the investigating officer at P.S. Budh Vihar tomorrow, that is, on 21.09.2019 at 10:30 a.m. He shall also not leave the National Capital Territory of Delhi without due permission of the IO. The present petition is allowed subject to the aforesaid conditions.

Needless to state that if any of the aforesaid conditions is violated, the anticipatory bail granted to the petitioner shall stand revoked without any further orders.
