Petitioner has invoked writ jurisdiction of this Court with following prayers:
"It is therefore prayed that this Hon'ble Court may kindly be pleased to issue appropriate Writ(s)/Orders(s)/Direction(s) thereby directing the respondent No. 2 to provide safety and security to the petitioners who intends to arrest the petitioners and tried to implicate in any false criminal case on the complaint filed by Respondent No. 3 to 5; A.
It is further prayed that issue the directions to the respondent no. 2 that he may not harass the petitioner at the instance of parents of the petitioners;
B.
Direct respondent no. 2 (SHO), PS Jaitpur to provide immediate and effective police protection to the life and liberty of the minor petitioners;
C.
Direct the respondents not to harass or intimidate the petitioner or his family;"
2.
Petitioner with his mother has personally appeared. Keeping in mind the vagueness of the prayer clause and looking into his age and background, I spoke with the petitioner and his mother in Hindi. 3.
It is explained by petitioner that in the course of fight with the private respondents, he hit brick on the head of respondent no. 3 in order to save himself. It is further alleged by petitioner that the private respondents are harassing him but the local SHO (respondent no. 2) refused to lodge his complaint alleging that he is a 'gangster'.
4.
Learned ASC assisted by Inspector Satbir Singh and IO/SI Inderjeet accepts notice and on their instructions, submits that the petitioner is involved in two cases, one being the assault and the other being robbery. Learned ASC has also shown me a small video clip posted by the petitioner on Instagram, depicting him with knife in hand and a bullet in his mouth. 5.
In the above circumstances, learned counsel for petitioner on instructions seeks permission to withdraw this petition. 6.
As requested, the petition is dismissed as withdrawn. 7.
But in view of submissions advanced today, the local SHO is directed to ensure security to the petitioner by sharing with him the mobile phone number of the beat constable so that at the time of distress, the petitioner may contact police. Further, as suggested by learned ASC, the IO shall take the petitioner to a Child Welfare Officer (CWO) so that he may be given a proper counselling.
