W.P.(CRL) 466/2026 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner setting aside of order dated 28.01.2026 passed by the Office of the Director General (Prisons), Prison Headquarters, Tihar, New Delhi, whereby the petitioner's application seeking modification of order dated 12.12.2025 whereby the petitioner was granted furlough, W.P.(CRL) 466/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. subject to furnishing one surety of Rs. 10,000 alongwith a personal bond in like amount.
Mr. Rajiv Bajaj, learned counsel appearing for the petitioner submits, that the petitioner is not able to get anyone to stand surety for him and seeks modification of the condition so that he be permitted to furnish cash surety in lieu of furnishing a surety bond.
This court has already taken a view on this issue in OBI Ogochukwa Stephen vs. State (NCT of Delhi).1 In view of the above, this court is not inclined to allow the present petition.
The petition is accordingly dismissed.
