After hearing arguments of some time, learned counsel for petitioner submits that every possible endeavour would be made to cross-examine the prosecutrix tomorrow and, if required, some alternate arrangement would also be made.

She, however, submits that cost had been imposed despite the fact that it was only on account of medical condition of the defence counsel that adjournment had been sought and, therefore, cost be waived. 3.

Though, the request in this regard was not entertained by the learned Trial Court, present petition is hereby disposed of as not pressed with liberty to petitioner to move application afresh before learned Trial Court seeking waiver of the cost.

As and when any such application is moved, learned Trial Court shall consider the same in accordance with law, without getting influenced by its CRL.M.C. 1065/2026 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
