Petitioner seeks quashing of the order dated 12.04.2023 of the learned trial court, whereby he was summoned to face trial for offence under Section 447 of the Companies Act.

Two issues arise at the outset. Firstly, there is no explanation for delay and laches in filing this petition. Secondly, as submitted, the matter is pending before the trial court for consideration of charge and that being so, why is it a fit case to invoke inherent powers instead of the trial court deliberating upon the framing of charge.

After addressing partly, learned counsel for petitioner seeks permission to withdraw this petition so that he may file appropriate application before the trial court seeking exemption of the petitioner from personal appearance.

As requested, the petition and the accompanying applications are dismissed as withdrawn.
