1. The present transfer petition under Section 24 of the Code of Civil Procedure, 1908 has been filed on behalf of the petitioner seeking transfer C.S.(Comm) No.3935/2021 titled as "Mrs. Anju Tyagi vs Mr. Vishwanath Singhal" from the Court of District Judge (Commercial10), Central, Tis Hazari Courts, Delhi to any other Court of District Judge (Comm), Central, Delhi, for trial.
2. Mr.Anil Kaushik, learned senior counsel for the petitioner submits that vide order dated 07.09.2024, learned District Judge (Commercial10), transferred the matter, inter alia, stating that due to personal reason, he does not wish to continue hearing of the present case. Principal District & Sessions Judge, Central, Tis Hazari Courts, Delhi. However, vide order dated 12.09.2024, the learned Principal District & Sessions Judge, in view of the judgment passed by this Court in CM (M) No.457 /2023 titled as Namita Gupta vs. Suraj Holdings Ltd., sent the matter back to the Court of the learned District Judge (Commercial-10), Central, Tis Hazari Courts, Delhi.
3. The Court considers that in view of the observations of the learned District Judge (Commercial-10), Central, Tis Hazari Courts, Delhi, as recorded on 07.09.2024, C.S.(Comm) No.3935/2021 titled as "Mrs. Anju Tyagi vs Mr. Vishwanath Singhal", is withdrawn from the Court of the learned District Judge (Commercial-10), Central, Tis Hazari Courts, Delhi, and is assigned to learned District Judge (Commercial-09), Central, Tis Hazari Courts, Delhi, for trial in accordance with the law.
4. The transferor Court is directed to send the entire record to the transferee Court. The parties are directed to appear before the learned District Judge (Commercial-09), Central, Tis Hazari Courts, Delhi on 15.04.2025.
5. Copy of the order be sent to the learned District Judge (Commercial09) and the learned District Judge (Commercial-10) Central, Tis Hazari Courts, Delhi, for compliance.
