This petition is filed on behalf of the Petitioners under Article 227 of the Constitution of India for quashing and setting aside order dated 23.01.2026 passed by learned District Judge, Commercial Court, West District, Tis Hazari Courts, New Delhi in CS (COMM) No. 109/2023 whereby the right to lead Defence Evidence of the Petitioners has been closed.

Ms. Gaganpreet Chawla, learned counsel enters appearance on behalf of the Respondents.

By the impugned order dated 23.01.2026, the learned Trial Court has closed Petitioners' evidence and matter is listed for final arguments on 16.02.2026.

be sick on 23.01.2026. Owing to this unavoidable circumstance, he was unable to come for evidence. He further submits that if given last opportunity, Defence Evidence will be concluded in one day and no further adjournment will be taken on any ground, whatsoever. 5.
Accordingly, for the reasons stated in the petition, impugned order dated 23.01.2026 is set aside. Defence Evidence will be led by the Petitioners on the date fixed i.e., 16.02.2026 and concluded on the same day. 6.
It is made clear that no further adjournment will be given to the Petitioners for leading Defence Evidence. After the Defence Evidence is concluded, Trial Court may list the matter for final hearing. 7.
Petition stands disposed of along with pending application in the aforesaid terms.
