On 01.09.2023, notice was directed to be served upon respondent No.2 however she is not present today. Learned APP on instructions from the IO states that she has duly informed the respondent no.2 about today's date, however, she has expressed her inability, being out of station. 2.

At this stage, learned counsel for the petitioner seeks leave to withdraw the petition.

Leave, as prayed for, is granted. The petition along with pending application is dismissed as withdrawn.

It is, however, clarified that this Court has not expressed any opinion on the merits of the case.
