The Petitioner has filed the present petition under Article 226 of the Constitution of India inter alia seeking appropriate writ restraining the Respondents from taking any coercive action against the Petitioner as well as to allow the Petitioner to participate in the survey conducted by the Town Vending Committee.

It is the case of the Petitioner that he has been in the trade of selling readymade garments near Gate No.1, AIIMS, New Delhi since 1982. According to the Petitioner, his name is a part of the list of 628 recognised vendors which was submitted before the Supreme Court on 30th April, 2012. He is stated to be appearing at serial no. 442 4.

According to the Petitioner, despite being included in the said list of recognised vendors, he is repeatedly subjected to interference by the police authorities near the hospital, who prevent him from squatting and vending his The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. wares. Hence the present petition seeking an order restraining the Respondents from taking any coercive action against the vending and squatting has been filed by the Petitioner.

The matter was listed on 3rd February, 2025. On the said date, the Petitioner was asked to file the copies of the original challans. Thereafter, the Petitioner was also directed to file photographs indicating the precise location from where he is carrying out his vending activities. Though some receipts have been placed on record, no photographs have been filed. 6.

Since the Petitioner's case is that he is a recognized vendor, in the opinion of this Court, all documents ought to be submitted to the Town Vending Committee and the Town Vending Committee ought to take a decision in respect of the permission for the Petitioner to vend as also participate in the survey which is currently being undertaken. 7.

Accordingly, let the Petitioner supply the relevant documents to the Town Vending Committee within a period of two weeks and a decision be taken by the Town Vending Committee by 30th June, 2025. The Petitioner shall also be permitted to participate in the survey being conducted by the TVC.

Petition is disposed of in these terms. All pending applications, if any, are also disposed of.
