This appeal has been filed by the Insurance Company challenging the impugned award dated 31st October 2025 passed by the Motor Accident Claims Tribunal, Saket Courts, New Delhi ('MACT') in MACT No.734/2018, awarding compensation of Rs.16,28,018/- along with interest @ 7.5% per annum.

The accident occurred on 25th March 2018, when Master Yakesh Sangwan (deceased) was sitting on a chair outside his house with his father and one Mr. Alok, when all of a sudden, a Tata Tiago car bearing registration no.DL-3T-CSZ-1891, being driven in rash and negligent manner, struck them with great force as a result of which the deceased suffered fatal injuries.

Considering that the issue in this appeal relates to the multiplier to be adopted in the case of death of a minor child below the age of 15 years, this Court has already taken a view, after considering all the relevant decisions of the Supreme Court and the High Court, in Rubi Devi And Anr. v. The New India Assurance Com. Ltd. And Ors. 2026:DHC:3674, wherein this Court held that a multiplier of '18' ought to be applied in such cases. 4.

The appeal is, therefore, dismissed. Pending applications, if any, are rendered infructuous.

Insurance Company will deposit the entire compensation amount, along with accrued interest, before the MACT within a period of 6 weeks, which will be released to the claimants as per the directions of the MACT in the impugned Award.

Statutory deposit be refunded to the appellant/Insurance Company only upon the deposit of the entire compensation along with accrued interest.
