This hearing has been done through hybrid mode. 2.

The present petition has been filed on behalf of the Petitioner- Dhanpal Singh under Article 226 of the Constitution of India seeking issuance of a writ in the nature of habeas corpus for production of his daughter, who is stated to have gone missing on 28th December, 2024.

On the last date, Mr. Lao , the ld. Standing Counsel (Criminal) had submitted that the daughter of the Petitioner may be accompanied by some suspect and their location is being traced. Today, a status report dated 17th February, 2025 has been filed informing the Court that all the steps were taken to trace the Girl. Finally, certain mobile numbers were obtained from the Petitioner and were analyzed. On the basis of the telephone records, the missing girl and the boy have been traced. They have been produced before the Court today. The status report is taken on record. The Court had an in-chamber interaction with them wherein they state that they have gotten married at Sheetla Mata Mandir, Gurugram on 5th January, 2025. The photographs of the marriage have been placed on record with the status report. The photographs show that there is another elderly lady present in the wedding and the boy informs the Court that the said lady is his mother.

The girl is over 20 years of age. The boy is doing daily jobs in Gurugram and is living on rent with his mother. He has two sisters who are married, one younger brother and a father. He states that his younger brother along with his father lives in Sirsa. The girl states that the Petitioner is her step-father. She has three brothers and four sisters, two of whom are married. 6.

The boy belongs to Village Sonarpura, Bhind District, Madhya Pradesh. He submits that his family has accepted the Girl. 7.

The mother of the girl also interacted with the couple in the chamber. However, the Court is the opinion that the interaction was not pleasant and the mother was extremely aggressive in her language to the couple. 8.

The girl has expressed clearly that she wants to accompany the boy. Considering that the girl is a major and has married the boy, she is accordingly allowed to accompany him.

However, considering that there are threats being levelled by the Petitioner and his wife to the couple, the IO is directed to take the couple out of the High Court premises through a safe route without making them meet the Petitioner.

The concerned SHO, PS Sector 14 Gurugram, shall also periodically from time to time contact the couple and ensure their well-being.
