% 31.05.2024 CM APPL. 34312/2024 (on behalf of the petitioner for seeking directions to R-3 to R-6 to comply with the order dated 08.02.2024 & 24.04.2024 and to restrain R-8 to 11 to carry out further illegal and unauthorized construction on the property in question) 7.

As per the order dated 24.04.2024, the learned counsel for the MCD informed the Court that the demolition order qua the unauthorized construction subsisting in the property in question has already been issued. It was also informed that the demolition action was scheduled for 24.04.2024 itself.

However, the learned counsel for the petitioner states that no demolition action took place but rather in the meanwhile the property in question has been constructed upto the 5th floor in an unauthorized manner. 9.

The learned counsel for the respondent/MCD submits that partial demolition action took place on the same day as was informed to the Court and further demolition is to happen today.
