The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of BNSS, 2023 seeking quashing of FIR No.0409/2022 under Sections 379/341/324/34 IPC registered at Police Station G.T.B.

The petitioner, as well as, respondent no. 2/complainant are present in the Court and they have been identified by their respective counsel, as well as, by the Investigating Officer W/SI Santosh Sirohi PS G.T.B. Enclave. 5.

The case of the prosecution is that there was a scuffle between the parties which escalated to a fight and led to the registration of two crossFIRs including the present FIR. 6.

The cross-FIR i.e. FIR No. 181/2021 under Section 341/506/325/34 IPC registered at PS G.T.B. Enclave is stated to have been quashed by a coordinate bench of this Court by an order of even date. 7.

Insofar as the present FIR is concerned, the statement of the complainant has already been recorded by the learned Joint Registrar and complainant has expressed that he has no objection in case the present FIR is quashed.

Having regard to the fact that parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between them.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 10.

In the present case, the State machinery has been put into motion and considerable time and resources of the investigating agency have been spent in the investigation of the matter, therefore, it is deemed appropriate to impose cost of Rs. 25,000/- on the petitioner. 11.

Accordingly, the petitioner is directed to deposit a cost of Rs. 25,000/- with the Delhi State Legal Services Authority and the said amount should be utilized towards counselling / psychological support to be provided to The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Consequently, the petition is allowed and the FIR No.0409/2022 under Sections 379/341/324/34 IPC registered at Police Station G.T.B. Enclave alongwith all other proceedings emanating therefrom, is quashed subject to payment of cost as aforesaid, within a period of two weeks from today.

The petition stands disposed of in the above terms. 14.
