This appeal has been filed by the Insurance Company challenging the impugned award dated 29th October 2025 passed by the Motor Accident Claims Tribunal, Central-District, Patiala House Courts, New Delhi ('MACT') in MACT No.425/2024, awarding compensation of Rs.33,43,708/- along with interest of 9% per annum. 2.
The accident occurred on 11th January 2024, when a minor child (Daniel Meti) was riding as pillion rider on scooty with his father, when they reached near Kidwari Mor, Palwal and took U-Turn, a truck bearing registration no. HR-38AD-2326 came from behind, being driven in a rash and negligent manner, and hit the scooty, which resulted in fatal injuries to Daniel Meti.

The issue in the appeal concerns the application of a multiplier of 18 and the minimum wages of a skilled worker applicable to the deceased, who was below 15 years of age. This Court has already taken a view, after considering all the relevant decisions of the Supreme Court and the High Court, Rubi Devi And Anr. v. The New India Assurance Com. Ltd. And Ors. 2026:DHC:3674, wherein the Court held that a multiplier of 18 ought to be applied in such cases.

The appeal is, therefore, dismissed. Pending applications are rendered infructuous.

Insurance Company will deposit the entire compensation amount, along with accrued interest, before the MACT within a period of 6 weeks, which will be released to the claimants as per the directions of the MACT in the impugned Award.

Statutory deposit be refunded to the appellant/Insurance Company only upon the deposit of the entire compensation along with accrued interest.
