This application is preferred on behalf of the Petitioner seeking revival of the writ petition on the ground that the undertakings given to the Court on 04.02.2025 by Respondents No.3 and 4 have been blatantly violated. Photographs have been annexed with the application to substantiate the plea that unauthorized construction has been carried on in the subject property despite undertakings not to carry out any unauthorized construction.

Replies be filed within two weeks from today. 5.

In the meantime, officials of MCD will carry out joint inspection of the subject property along with a representative of the Petitioner and Respondents No.3 and 4 or their representatives, within two days from today. The joint inspection will be videographed and still photographs will also be taken by MCD officials, which will be appended to the report. Inspection will be carried out after intimating the time and date to the other stakeholders and will be personally supervised by the concerned Executive Engineer, MCD. Inspection report will be looked into and signed by the concerned Chief Engineer and will be brought to Court by learned counsel for MCD on the next date of hearing. Respondents shall ensure that status quo is maintained on the property till the joint inspection is carried out within the next two days.
