After some arguments, the petitioners have agreed to shift the partition wall to provide an additional two and a half feet of space on one side. The rough map as to how the wall will now be shifted is handed over by the learned counsel appearing for the parties and the same is taken on record. The existing partition to cordon of a five feet wide area, which is also being used as a kitchen, is required to be demolished to include the said area in the common area. The modifications to be made are reflected in the rough map, handed over by the counsel appearing for the parties. The modifications as indicated therein shall be carried out by the petitioners within a period of two weeks from today.

It is further clarified that the toilet on the second floor will be used exclusively by the respondents and the petitioner shall ensure that there is no obstruction to the same.

The order dated 15.02.2018 is modified to the aforesaid extent.

Needless to state that this order does not, in any manner, determine the ownership rights of either party.

The application stands disposed of.
