This hearing has been done through hybrid mode. 2.
This is a petition seeking appointment of Arbitrators under Section 11(6) of the Arbitration and Conciliation Act, 1996. 3.
The dispute between the parties arises out of a contract dated 22nd December, 2021 for supply for railway signalling cables. It is averred that the Respondent failed to comply with the conditions of contract clause. 4.
Notice was issued in this petition on 9th February, 2024, and Mr. Apoorv Kurup appears today for the Respondent. He submits that under the Clause related to appointment of Arbitrator, if the claim is more than Rs.1 crore, a panel of three Arbitrators has to be appointed. He has suggested that the said Arbitrators may be appointed from the Empanelled Arbitrators' list maintained by the Railways. Ld. Counsel for the Petitioner has no objection in this regard.
