The present petition has been filed by the defendant who is aggrieved by the order dated 09.12.2023 whereby her application moved under Order VI Rule 17 of CPC was partly allowed.

Learned counsel for respondent also appears and it is informed that the present petition has become infructuous as the suit as such has been directed to be returned vide order dated 21.02.2024.

Learned counsel for petitioners does not dispute the aforesaid fact and does admit that the suit has already been returned. 4.

In view of the fact that now nothing is pending before the learned Trial Court and the suit as such has been directed to be returned, accordingly, the present petition is disposed as having become infructuous.
