$~47 * IN THE HIGH COURT OF DELHI AT NEW DELHI + CRL.M.C. 301/2018 and Crl.M.A.1153-1154/2018 BAGICHA SINGH KAHKH ..... Petitioner Through:
Mr. Anwesh Madhukar, Advocate versus STATE NCT OF DELHI ..... Respondent Through:
Mr. Arun Kumar Sharma, APP for the State with SI Mukesh Baliyan
CORAM:
HON'BLE MR. JUSTICE R.K.GAUBA
O R D E R
% 23.07.2018 The prayer for quashing of FIR No.86/2015, registered at Police Station IGI Airport, under Section 25 of the Arms Act cannot be entertained at this stage where the police has already concluded its investigation and has submitted charge-sheet on finding sufficient material on the basis of which the court of cognizance has also issued process, the case being at the stage of charge.
It is inherent in these facts that the petitioner did not place the defences on the basis of which he has come up to this court seeking quashing, offering some explanation for the possession of the ammunition. The contentions raised here thus, give rise to questions of facts which cannot be addressed under jurisdiction under Section 482 Cr.P.C. The petition and the pending applications stand dismissed. R.K.GAUBA, J.
