This joint application is filed on behalf of the parties under Order XXIII Rule 3 read with Section 151 CPC for recording the settlement. 2.

The present suit has been instituted by the Plaintiffs inter alia for permanent injunction restraining Defendant from infringing Plaintiff No. 1's Indian Patent No. 229051 ('suit patent IN'051'). 3.

No written statement has been filed by the Defendant. 4.

It is stated in the application that during the pendency of the suit, the term of the suit patent IN'051 expired on 16.01.2023, owing to which parties have amicably settled all their disputes. The terms of settlement are recorded in paragraphs 3, 4 and 5 of the application.

Court has perused the terms of the settlement and finds the same to be lawful. On account of the suit patent IN'051 having expired, parties have agreed that Plaintiffs will forego the claim for injunction, damages, rendition of accounts of profits, delivery up, etc and that no party will be entitled to claim any damages in connection with the present proceedings, amongst other terms.

Accordingly, the application is allowed recording the settlement between the parties.

Application stands disposed of.

The suit is decreed in terms of the settlement. 9.

Registry is directed to draw up the decree sheet. 10.

Date of 23.03.2026 stands cancelled.
