The present petition filed under Section 528 of the BNSS seeks quashing of FIR No. 621/2024, under Sections 403/406/420/468/34 of the IPC, registered at P.S. Shalimar Bagh.

Learned counsel appearing on behalf of the petitioners submits that during the pendency of the present FIR, parties have arrived at a settlement vide agreement dated 18.12.2024. It is further pointed out that in the FIR apart from the present petitioners one Mr. Manish Kumar is also a party, however, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
inadvertently he could not be made a party in the present petition though he is a signatory to the aforesaid agreement.

Mr. Manish Kumar is present in Court today in person and on oral request he is arrayed as petitioner no. 4 in the present petition. Let the amended memo of parties be filed during the course of the day. 6.
On 18.12.2024, parties arrived at a settlement and as per the said settlement deed, petitionershave agreed to pay an amount of Rs. 2,06,00,000/- to the respondent no.2. The copy of the aforesaid settlement deed dated 18.12.2024 is on record (Annexure P-4).

Further, as per the settlement deed, an amount of Rs. 1,00,00,000/- has already been paid to respondent no.2 and the remaining amount of Rs. 1,06,00,000/- has been paid to her in court today, by means of a demand draft. 8.
Petitioners no. 1 and 4 and complainant/respondent no. 2 are present before the Court and petitioners no 2 and 3 are present through video conferencing and have been duly identified by their respective counsel, as well as the Investigating Officer, SI Dhiraj Singh, PS Shalimar Bagh. 9.
Two demand drafts bearing no. 622467 and 622466 dated 10.07.2025 for Rs. 20,00,000/- and 86,00,000/- respectively drawn on Punjab National Bank has been handed over to the complainant/Respondent No.2, who acknowledges the receipt of the same.

The complainant/respondent No.2 states that the matter has been settled with the petitioners and she has no objection if the FIR is quashed. She further states that all the terms of the agreement have been complied with. 11.
The learned APP for the State submits that present FIR is pending investigation and the chargesheet has not been filed. 12.
In Gian Singh v. State of Punjab, (2012) 10 SCC 303, the Hon'ble The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Supreme Court has recognized the need of amicable resolution of disputes by observing as under:- "61. ... In other words, the High Court must consider whether it would be unfair or contrary to the interest of justice to continue with the criminal proceedings or continuation of criminal proceedings would tantamount to abuse of process of law despite settlement and compromise between the victim and the wrongdoer and whether to secure the ends of justice, it is appropriate that criminal case is put to an end and if the answer to the above question(s) is in the affirmative, the High Court shall be well within its jurisdiction to quash the criminal proceeding."

In view of the aforesaid circumstances, and the fact that the parties have put a quietus to the dispute, no useful purpose will be served in continuing with the present FIR No. 621/2024, under Sections 403/406/420/468/34 of the IPC, registered at P.S. Shalimar Bagh.

In the interest of justice, the petition is allowed, and the FIR No. 621/2024, under Sections 403/406/420/468/34 of the IPC, registered at P.S. Shalimar Bagh, is hereby quashed, subject to payment of cost of Rs. 2,00,000/- to be deposited by the petitioners with the Delhi High Court Advocates Welfare Trust (Bank Account No.-15530210002995, IFSCUCBA0001553), within a period of 10 days from today. 15.
Petition is allowed and disposed of accordingly. 16.
