O R D E R

Learned Senior Counsel for the Petitioner states that a petition under Section 11 of the Arbitration and Conciliation Act, 1996 was filed before the Supreme Court and a vide order dated 18.10.2024 Sole Arbitrator has been appointed.

He states that the ad-interim Order dated 14.02.2023 passed in the present petition is in operation. He states that the present petition be placed before the Sole Arbitrator to be dealt with as per Section 17 of the Arbitration and Conciliation Act, 1996.

Learned Counsel for the Respondent, on instructions, states that he has no objection to the suggestion put forth by the learned Senior Counsel for the Petitioner. He states that Respondent will file its reply to this petition within four weeks.

Accordingly, with the consent of all parties the present petition filed under Section 9 of the Arbitration and Conciliation Act, 1996 is disposed of with the liberty to the Petitioner to place this petition before the learned Sole Arbitrator for deciding the same in accordance with Section 17 of the Arbitration and Conciliation Act, 1996 and until the disposal of the said Section 17 application, the ad-interim Order dated 14.02.2023 shall continue.

The Respondent shall file its reply within four weeks. Rejoinder, if any, be filed within two weeks thereafter.

Parties shall complete the pleadings within the time sought before this Court.

The parties will approach the learned Sole Arbitrator within two weeks for fixing the date of hearing in the application under Section 17 of the Arbitration and Conciliation Act, 1996.

With the aforesaid directions, the petition stand disposed of along with pending application(s), if any.
