Learned counsel appearing for the petitioner, after making brief submissions, acknowledges that under the Representation of Peoples Act, 1951, the election petition can only be presented once the election is notified and, therefore, seeks liberty to withdraw the instant petition with further liberty to file it at an appropriate stage if the occasion arises. 4.

With the aforesaid liberty and leaving all contentions open, the instant petition stands dismissed as withdrawn.
