None appears for the plaintiffs, when the matter is called out. 2.

None had appeared for the plaintiffs even on the last date of hearing. 3.

Learned counsel appearing for defendant no. 1 submits that the present is a frivolous suit, as the agreement between the parties was a consent agreement, as filed in CS(OS) 558/2014 and CS(OS) 3121/2011. 4.

It is submitted that the defendant no. 1 had earlier filed contempt proceedings against the plaintiffs, being CONT.CAS(C) 755/2021, titled as "Pritpal Singh Versus Jupinder Kaur Maker & Anr.", wherein, the Court has already passed a judgment dated 14th November, 2025, holding the plaintiffs herein as guilty of contempt.

It is submitted that the Division Bench of this Court has already confirmed the said order vide its judgment dated 17th December, 2025 in CONT. APP. (C) 20/2025. Further, an appeal before the Supreme Court has also been dismissed on 16th January, 2026, in Special Leave to Appeal (C) 1534/2026, titled as "Ajit Singh Maker & Anr. Versus Pritpal Singh". 6.

Accordingly, the present suit along with the pending applications, is dismissed for non-prosecution.

Considering the submissions made before this Court, a cost of Rs. 1,00,000/- (Rupees One Lac Only) in total is directed, to be paid jointly and severally by the plaintiffs to defendant no. 1, within a period of 8 weeks, from today.

In case, the aforesaid cost is not paid to the defendant no. 1 within the stipulated period, the defendant no. 1 is granted liberty to approach this Court, by way of an appropriate application in that regard.
