% 21.03.2017 By the present petition the petitioner seeks parole on the ground that he has to undertake renovation of the house and take care of the old mother who is suffering from an eye problem.
On a notice being issued a status report has been filed. As per the status report the petitioner has four brothers who are all married and earning their livelihood and residing in the same house i.e. H.No. 235, Koko Bagri Karala Delhi. Besides the father of the petitioner is also running a hotel. The eye of the mother has already been operated and there are other family members to look after the mother. Further the plot which according to the petitioner needs construction is in the name of the father of the petitioner and no construction activity was going on when it was visited. The petitioner was granted three furloughs and one parole in the last year. W.P.(CRL) 290/2017
Considering the fact that there is no pressing urgency for which the presence of the petitioner is required at his home, this Court finds no reason to disagree with the order of the competent authority rejecting parole of the petitioner.
Petition is dismissed.
Copy of the order be communicated to the petitioner through Superintendent Tihar Jail.
