The Central Administrative Tribunal, Principal Bench, New Delhi [hereinafter referred to as 8Tribunal9] has come to a conclusion that substantial compliance of the directions issued has already been made and hence, there is no reason to initiate contempt proceedings against the Respondent.

Learned counsel representing the Petitioner submits that there is some error in fixation of amount of family pension. Admittedly, the Petitioner has already filed O.A. No.3013/2023, which is pending before the Tribunal. However, learned counsel representing the Petitioner submits that the O.A is only restricted to fixation of pension on the recommendation of the 7th Central Pay Commission and on revision of pension of pre-2016 pensioners.

Jurisdiction under the Contempt of Courts Act, 1971 can be initiated only if there is gross and wilful violation of previous direction.

In the present case, the question is of calculation and fixation of pension. This matter can be better adjudicated in Execution Petition. 5.

Hence, continuation of contempt proceedings will not be appropriate. However, if the Petitioner files execution or avails any other remedy for the implementation of previous order, the same shall be taken up and disposed of expeditiously.
