The petitioner filed this writ petition under Article 226 of the Constitution assailing an order dated 17.02.2024 by which he has been removed from the post of Vice Chancellor, Delhi Pharmaceutical Sciences and Research University ["University"]. 2.

order dated 29.08.2016 issued by the Director (Training and Technical Education), Government of National Capital Territory of Delhi ["GNCTD"]. The order states that the appointment has been made by the Lt. Governor of Delhi. The impugned order has been signed by the Secretary (Training and Technical Education), GNCTD and is stated to be "under the orders of the Chancellor, DPSRU/Hon'ble Lt. Governor, Delhi".

As both the appointment and the removal order have been made by GNCTD, I have enquired of Mr. Rajiv Kapur, learned counsel for the petitioner, as to whether the petitioner's grievances would fall within the jurisdiction of the Central Administrative Tribunal ["Tribunal"] under the Administrative Tribunals Act, 1985.

Ms. Laavanya Kaushik, learned counsel for GNCTD, states upon instructions, that the grievances are amenable to the jurisdiction of the Tribunal.

In view of the above, Mr. Kapur seeks permission to withdraw this writ petition with liberty to approach the Tribunal. 6.

The writ petition is dismissed as withdrawn, with liberty as aforesaid.
