The appellant is present along with her counsel. 2.

The respondent is also present along with his counsel. 3.

The learned counsel for the appellant, on instructions from his client, submits that the appellant do not want to press the present appeal and seeks permission to withdraw the same. He further submits that the appellant undertakes to produce the minor child before the learned Family Court, where the proceedings between the parties are pending, and is next listed on 23.01.2026 for handing over the custody of the child to the father/respondent.

The learned counsel for the appellant also seeks liberty to file an appropriate fresh application with regard to the custody of the child before the learned Family Court, in accordance with law. The aforesaid request of the appellant is accepted and the liberty is granted to the appellant. The appellant/mother is directed to produce the minor child before the learned Family Court on 23.01.2026 for handing over the custody to the respondent/father. 6.

It shall be open for the appellant to file an appropriate application before the learned Family Court, which shall consider and decide the same, after hearing the parties concerned, in accordance with law.

With the aforesaid directions, the appeal along with pending application stands dismissed as withdrawn.
