The present petition under Section 9 of the Arbitration and Conciliation Act, 1996 has been filed by the Petitioner with the following prayers:

"a. Grant interim injunction against the respondents to misrepresent itself to the outside world with name and style of and/or sister concern of Petitioner M/S „Girivar Global Solutions & Services LLP'. And/or b. Restrain the Respondent from procuring tender(s) and working orders by representing itself as the sister concern of the Petitioner LLP and/or c. Restrain the Respondent(s) from using the Letterheads and other paraphernalia of Petitioner's LLP till the disposal of Arbitration Proceedings. d. To restrain the Respondents from spreading false information in the market against the Petitioner and thereby affecting the reputation, goodwill and business of the Petitioner;

g. To pass such other order or direction as deemed fit and proper in the facts and circumstances of the present case."

This Court on 13.03.2023 passed the following Order: "1. Learned counsel for the respondents seeks some time to file reply. Let the same be filed within a period of four weeks from today. Rejoinder thereto, if any, be filed within a period of two weeks thereafter.

2. In the meantime, learned counsel for the respondents undertake that the respondent no.1 shall continue to remain bound with the covenant contained in clause 6(xvi) of the Memorandum of Understanding dated 18.11.2019, which reads as under:- "'xvi) Second Party shall not further file any tender in Railways or at any forum or portal in the name of Girivar Global Solutions & Services LLP."

Pursuant to the aforesaid Order dated 13.03.2023, a petition being ARB.P. 90/2023 was filed before this Court by the Petitioner under Section 11 of the Arbitration and Conciliation Act, 1996 and this Court vide Order dated 15.01.2024 had constituted an Arbitral Tribunal. 4.

In view of the fact that an Arbitral Tribunal has already been constituted by this Court and the proceedings are going on before the Arbitral Tribunal, the Interim Order dated 13.03.2023 passed by this Court The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

With these observations, the petition is disposed of, along with pending application(s), if any.
