Applicant seeks regular bail in FIR No. 338/2018 dated 20.06.2018 under Sections 302, IPC, 1860 and Sections 25/27 of Arms Act, 1959 at P.S. Jait Pur. 2.
The alleged incident is of 20.06.2018 and the accused was arrested from the spot itself, immediately, after the murder in question. He was apprehended by HC Govind Ram, who had, allegedly, seen the stabbing incident. The abovesaid incident was also witnessed by one Sh. Akash Sharma. 3.
Since the accused is in custody for quite some time, learned Addl. P.P. for the State was requested to get Nominal Roll of the petitioner placed on record today itself. The same has been placed on record which also indicates that he is in custody since 20.06.2018, albeit, in between during COVID-period, he was released on bail as per HPC Guidelines. His actual incarceration period is of around 6 years.

Nominal Roll also indicates that he has no other involvement of any nature.

Admittedly, 15 out of 28 cited prosecution witnesses have already graced witness box and both the abovesaid material witnesses i.e. HC Govind Ram and Sh. Akash Sharma, have also entered into witness box. 6.
As per Arrest Memo, the age of the petitioner was 24 years at the relevant time.

Keeping in mind applicant's long period of incarceration, his previous clean antecedents and the fact that the material public witnesses have already been examined, applicant is hereby admitted to bail on his furnishing personal bond in a sum of Rs. 25,000/- with one surety of like amount, subject to the satisfaction of learned Trial Court, Chief Judicial Magistrate/Duty Judicial Magistrate First Class with the following conditions: - (i) Applicant shall not try to contact any of the public witness, directly or indirectly.
(ii) He shall not leave the National Capital Territory of Delhi without prior permission of learned Trial Court.
(iii) Applicant shall furnish a mobile number to concerned IO on which he can he contacted, if required. Such number shall remain operational and functional.

Application stands disposed of in aforesaid terms. 9.
