CRL.M.C. 1140/2026 At the outset, Mr. Vivek Gurnani, learned Panel counsel appearing for the respondent/Directorate of Enforcement ('ED') states that the petitioner has already been heard by the learned Special Judge at the stage of taking cognizance of the ED's complaint under section 223 of the Bharatiya Nagarik Suraksha Sanhita 2023 ('BNSS').

Counsel submits that the petitioner is entitled to raise the issues, which have been raised by way of the present petition, in the course of hearing before the learned Special Judge.

In view of the above, after a brief hearing in the matter, and as prayed-for by learned counsel for the petitioner, the present petition is disposed-of, with liberty to the petitioner to raise all the grounds taken in the present petition before the learned Special Judge in the course of the hearing under section 223 of the BNSS.

Pending applications, if any, also stand disposed-of. All rights and contentions of the parties are left open. Needless to add, this court has not expressed any opinion on the merits of the matter.
