JUDGMENT

SANJEEV SACHDEVA, J 1.

Petitioner seeks reference of disputes to an Arbitral Tribunal pursuant to agreement dated 30.12.2020 with regard to the comprehensive maintenance work at CGO Complex, Lodi Road, New Delhi.

Learned counsel for the petitioner submits that an Arbitral Tribunal has already been constituted in respect of the same agreement, however, for different claims. He submits that the Arbitral Tribunal was approached for adjudicating the claims that are subject matter of this petition, however, the Arbitral Tribunal by order dated 07.01.2022 has declined to entertain the same solely on the ground that these claims have not been referred to the Tribunal. 3.

Learned counsel for respondent submits that they have no objection in case the claims that are subject matter of this petition are also referred to Sh. Nand Lal Singh, the sole Arbitrator. 4.

In view of the above and with the consent of the parties, this petition is disposed of. The claims subject matter of this petition are also referred to Arbitral Tribunal comprising of Sh. Nand Lal Singh. 5.

The petition is allowed in the above terms.
