CRL.REV.P.(MAT.) 75/2026 CRL.M.A. 4575/2026 (stay) By way of the present criminal revision petition filed under section 438 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with section 19(4) of the Family Courts Act, 1984 the petitioner/husband impugns order dated 08.12.2025 whereby the learned Family Court has awarded ad-interim maintenance at Rs.10,000/- per month in favour of the respondent (wife).

The petition under section 125 of the Code of Criminal Procedure 1973 ('Cr.P.C.'), is still pending consideration before the learned Family Court and is listed next on 28.04.2026 for recording the evidence of the respondent.

In view of the above, after a brief hearing in the matter, and considering that the impugned order only awards ad-interim maintenance, in light of section 397(2) Cr.P.C./438(2) BNSS, this court is not inclined to entertain the present petition. 4.

The present revision petition is accordingly dismissed, with liberty to the petitioner to raise all his rights and contentions before the learned Family Court in the course of the proceedings pending there, as may be permissible, in accordance with law.
