This hearing has been done through hybrid mode. 2.

The present application is the second bail application under Section 439 of the Cr.P.C. (Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023) read with Section 482 of the Cr.P.C. (Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023) seeks regular bail in case FIR No. 1582/2016, under Section 302/307 of the IPC and Sections 25/27 of the Arms Act, registered at P.S. Mehrauli.

Learned counsel appearing on behalf of the applicant that the prosecution evidence in the present case is complete except for the examination of the concerned Investigating Officer which is pending for the last six months. He further seeks leave to withdraw the present application with prayer seeking direction to the learned Trial Court with regard to the examination of the Investigating Officer.
