O R D E R

The present writ petition has been filed seeking a direction to the respondent no.1/ MCD to forthwith demolish the unauthorized construction carried out at property bearing no. 1/6434, Plot Nos. 5 & 6, Gali No. 5, East Rohtash Nagar, Shahdara, Delhi-110032.

It is submitted by counsel for the petitioners that the aforesaid construction has been carried out in a 66 sq. yards area, which forms part of the overall plot of 150 sq. yards belonging to the petitioners. 3.

The grievance of the petitioners is that the show cause notice was issued by respondent no.1/ MCD on 30th October, 2025 to the respondents W.P.(C) 1871/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. no.2 and 3. However, no action has been taken against the unauthorized construction.

Status report has been filed on behalf of respondent no.1/ MCD in Court today.

4.1.

The same is permitted to be taken on record.

In the said status report, it is stated that a demolition order was passed on 11th February, 2026. In respect of the property of the petitioners also, a demolition order was issued on 11th February, 2026. However, the demolition action fixed for both properties on 17th March, 2026 and 27th March, 2026 could not be carried out due to rain and resistance from the local public.

It is submitted that demolition action has now been fixed for 27th April, 2026.

None appears on behalf of the petitioners.

Accordingly, the present writ petition is disposed of, while directing respondent no.1/ MCD to carry out the proposed demolition action as scheduled on 27th April, 2026.

The respondent no.4/ SHO, P.S. Shahdara GT Road, shall provide necessary police force to the respondent no.1/ MCD for carrying out the proposed demolition action.

The present petition along with all pending application stands disposed of in terms of above.

All rights, contentions and legal remedies of the parties are kept open.
