The present writ petition has been filed by the petitioners aggrieved by the Show Cause Notice dated 30th October, 2025 issued by the respondent/ MCD against the unauthorized construction carried out by the petitioner.

Counsel appearing for the respondent/ MCD submits that pursuant to the aforesaid Show Cause Notice, a demolition order has been passed on 27th January, 2026. maintainable as the remedy of the petitioners would be approach the Appellate Tribunal, MCD.

Counsel for the petitioners submits that unauthorized construction as pointed out by the respondent/ MCD shall be removed by the petitioners themselves within 15 days.

In view of the above, the present writ petition stands disposed of. 6.

Needless to state, in the event the petitioners do not remove the unauthorized construction carried out by them, the respondent/ MCD shall be free to proceed against the same in accordance with law. 7.

In the event, the petitioners have any further grievance, the petitioners would be free to invoke the remedies available in law.
