The instant petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 („Cr.P.C.‟) has been filed on the behalf of petitioner seeking issuance of writ of mandamus directing the respondent to grant parole to petitioner for a period of 08 weeks to accompany his wife both during and after IVF cycle. 2.

Issue notice. Ms. Rupali Bandhopadya, learned ASC accepts notice on behalf of State.

The competent authority was not approached by the present petitioner before approaching this Court. The petitioner may approach the competent authority who will decide the application filed by the petitioner herein for grant of parole within one month under intimation to the petitioner. 4.
