O R D E R
% 10.02.2025 Pursuant to last order dated 06.02.2025, Mr. Tarang Srivastva, learned APP appearing on behalf of the State has handed-up a copy of Status Report dated 10.02.2025 alongwith copies of certain medical documents in support of what has been recorded in the status report. The status report and supporting documents are taken on record. 2.
The status report narrates that upon verification, it is found that the petitioner's wife is under treatment of Dr. Vikrant Katiyar at the Chawla Surgical Centre, Rajouri Garden, New Delhi; and the doctor has opined that the petitioner's wife is a diagnosed case of lumbar canal stenosis and has presented with a chronic history of low back pain with radiating pain in both lower limbs. 3.
Furthermore, the attending doctor has confirmed that though the wife has been under treatment for several months, there has been no improvement in her condition; and that even though the illness is not life threatening, she has been advised lumbar surgery, for which she has been advised to get herself admitted on 12.02.2025. The doctor has also opined that post-surgery the petitioner's wife would require bed rest for 10-14 days, depending on her postoperative condition. 5.
Upon being specifically queried, Mr. Pranay Abhishek, learned counsel appearing on behalf of the petitioner submits, that the wife's surgery is scheduled at the Chawla Surgical Hospital under the care of Dr. Vikrant Katiyar, who has certified to her condition, as has been recorded in the status report.

In light what has been recorded in their status report, learned APP leaves it to the court to pass appropriate orders. 7.
In view of the above, and on humanitarian considerations, the present petition is allowed, thereby granting to the petitioner - Manoj Kumar s/o Sh. Nand Lal - interim bail for a period of 04 weeks from the date of his release, subject to the following conditions : 7.1. The petitioner shall furnish a personal bond in the sum of Rs. 25,000/- (Rs. Twenty-five Thousand Only) with 02 local sureties in the like amount to the satisfaction of the learned trial court;
7.2. The petitioner shall not leave the State of Delhi without permission of the court and shall ordinarily reside at the address as per prison records;
7.3. The petitioner shall furnish to the Investigating Officer ('I.O.') a cell-phone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times;

7.4. If the petitioner has a passport, he shall surrender the same to the learned trial court and shall not travel out of the country without prior permission of this court;
7.5. The petitioner shall not contact, nor visit, nor offer any inducement, threat or promise to any of the prosecution witnesses or other persons acquainted with the facts of case. The petitioner shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial; and 7.6. Upon expiry of the period of interim bail, the petitioner shall surrender before the Jail Superintendent forthwith. 8.
It is further directed that if the petitioner's wife does not undergo surgery within 01 week of the scheduled date for admission i.e., 12.02.2025, the petitioner shall surrender back to custody forthwith. 9.
Also, the I.O. is directed to visit the Chawla Surgical Centre, Rajouri Garden, New Delhi to verify that the petitioner's wife gets admitted to that facility for purposes of surgery.

A copy of this order be sent to the concerned Jail Superintendent forthwith.

The petition is disposed-of in the above terms. 12.
Pending applications, if any, also stand disposed-of. 13.
