The present writ petition has been filed under Articles 226 and 227 of the Constitution of India seeking issuance of a writ of certiorari, mandamus, or any other appropriate writ, order, or direction, interalia, for quashing and setting aside the impugned final order dated 18.09.2024 passed by the learned Presiding Officer, Debts Recovery Tribunal-II, Delhi ("DRT") in Securitization Application (TSA) No. 121 of 2022, titled Tushar Dev v. classification as void ab initio on account of fraud; and for restitution of the subject property to the petitioner.

Learned counsel for the petitioner submits that, in view of certain facts which have come to their knowledge subsequent to the passing of the order by the learned DRT, they seek leave to withdraw the present petition with liberty to file a review application before the learned DRT. 5.

In view of the aforesaid submission, the present writ petition stands dismissed as withdrawnwith liberty to the petitioner to approach the appropriate authority, as may be permissible in accordance with law. 6.
