The present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereafter „BNSS‟) has been filed on behalf of the applicant seeking grant of interim bail for a period of 04 weeks, in case arising out of FIR bearing no. 480/2020 dated 13.09.2020, registered at Police Station Dayalpur, Delhi for the offences punishable under Section 302/307/120B/34 of the Indian Penal Code, 1860 (hereafter „IPC‟) and Section 25/27 of the Arms Act, 1959.

This Court has gone through the order dated 30.01.2025, vide which an apprehension was expressed regarding the nature of offence committed and the manner of commission of crime, that is two murders on the same day, due to which the learned Trial Court was not inclined to grant him interim bail. However, the accused/ applicant was permitted to attend marriage of his real sister for three hours under police custody. Further, it is submitted that the father of the accused/applicant is not willing to call his son for marriage, under police custody.

The learned counsel for the accused states that it will be suffice if the present petitioner is permitted to attend the wedding for 06 hours, instead of 03 hours, under police custody.

This Court has heard arguments addressed on behalf of both the sides and has perused the material available on record. 8.

Considering the overall facts and circumstances of the present case, this Court is inclined to grant interim bail for 06 hours to the present petitioner. The police official on duty shall be in plain clothes. Rest of the conditions, imposed if any by the learned Trial Court shall remain the same. 9.

Accordingly, the present petition stands disposed of, in above terms. 10.

A copy of this order be sent by the Registry to the Jail Superintendent for information.
