O R D E R
% 13.02.2026 BAIL APPLN. 607/2026 By way of the present petition filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks interim bail for 03 weeks to attend the wedding of his sister, which is scheduled on 15.02.2026, with the ceremonies commencing from 13.02.2026 in Sahibabad, Ghaziabad, Uttar Pradesh. 2.
Notice on this petition was issued on 11.02.2026. 3.
Mr. Shoaib Haider, learned APP appearing for the State has handedup Status Report dated 11.02.2026. He has also handed-up the petitioner's Nominal Roll dated 13.02.2026. The same are taken on record.

Intimation has been served upon the next-of-kin of the deceased, his wife, Ms. Rekha, who is present in-person.

as an undertrial; his jail conduct has been 'satisfactory'; and he has no other criminal involvements.

Counsel submits, that the petitioner's sister is getting married on 15.02.2026; and his presence for the pre-wedding and wedding functions is required as a matter of tradition. 7.
In the status report filed, the Investigating Officer ('I.O.') has verified the factum of the wedding. He has also appended the statements of the petitioner's father and neighbours, who confirm that fact. 8.
The nominal roll confirms that the petitioner has spent more than 02 years in custody; his jail conduct has been 'satisfactory'; and he has no other criminal involvements.

Upon being queried, the wife of the deceased states, that though she resides a few lanes away from where the petitioner used to reside, she has never received any threats from any of the family members of the petitioner.

Upon a conspectus of the foregoing, and in view of the ground cited for interim bail, this court is inclined to allow the present petition. 11.
Accordingly the petitioner - Avinash @ Golu, s/o Amit Kumar - is granted interim bail for a period of 01 week from the date of his release subject to the following conditions:
11.1. The petitioner shall furnish a personal bond in the sum of Rs. 15,000/- (Rs. Fifteen Thousand Only) with 01 surety in the like amount from a family member, to the satisfaction of the learned trial court/learned Duty Magistrate.

The petitioner shall furnish to the Investigating Officer/S.H.O P.S.: Sultanpuri, Outer District, Delhi a cell-phone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times;
11.4. If the petitioner has a passport, he shall surrender the same to the learned trial court/learned Duty Magistrate and shall not travel out of the country without prior permission of this court; 11.5. The petitioner shall not contact, nor visit, nor offer any inducement, threat or promise to any of the prosecution witnesses or other persons acquainted with the facts of case. The petitioner shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial; and 11.6. Upon expiry of the period of interim bail, the petitioner shall surrender before the Jail Superintendent.

The petition is disposed-of in the above terms. 13.
Pending applications, if any, also stand disposed-of. 14.
Let a copy of this order be communicated by the Registry to the concerned Jail Superintendent expeditiously.
