The present writ petition has been filed seeking direction to the respondent/MCD not to carry out any further demolition action qua property bearing Plot No.699, Khasra No.740, 496 Village Chirag Delhi, New Delhi without following due process of law.

Counsel appears on behalf of the respondent/MCD and submits that partial demolition action has already been taken by the respondent/MCD on 9th February, 2026. She further submits that the proper remedy of the petitioner would be to approach the Appellate Tribunal, MCD (hereinafter 'ATMCD').

In view thereof, counsel for the petitioner seeks to withdraw the present writ petition with liberty to approach the ATMCD within fifteen (15) days from today.

Accordingly, the present writ petition, along with pending applications, is disposed of while giving liberty to the petitioner to approach W.P.(C) 1921/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. ATMCD within fifteen (15) days from today.

Till the time ATMCD considers the matter, including any application for interim stay, no coercive action shall be taken by the respondent/MCD. 6.
