The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereafter „BNSS‟) has been filed on behalf of the petitioner seeking quashing of FIR bearing no. 0029/2025 dated 17.01.2025 registered at Police Station Dwarka, Delhi for the offences punishable under Section 420/468/471/120B of Indian Penal Code, 1860 (hereafter „IPC‟). 2.
Briefly stated, the facts of the present case are that a dispute arose between the parties in respect of property bearing Flat No.604, Bhartiya CGHS Limited, Sector-19, Dwarka, South West District, Delhi and respondent no.2 had filed a Civil Suit no. 394/2024 before the learned District Judge, Dwarka Courts, South West District, Delhi, against the petitioners. Thereafter, respondent no. 2 had filed the present FIR. consent decree dated 28.01.2025 passed in favour of respondent no. 2 and the petitioners had undertaken to handover the peaceful vacant possession of the abovesaid property alongwith its keys to respondent no.2. 3.
Petitioner is present before this Court and has been identified by his counsel Mr. Sunil Upadhyay and Investigating Officer (IO) from Police Station Dwarka, Delhi.

On a query made by this Court, respondent no.2 who has been identified by the IO, has categorically stated that he has entered into compromise out of his own free will and without any pressure, coercion or threat. It is also stated by respondent no.2 that the entire dispute has been amicably settled between the parties vide Compromise Deed/Memorandum of Understanding („MoU‟) dated 23.01.2025 entered into between them and that he has no objection, if the present FIR is quashed. 5.
Considering that the separate statement of the parties, as per the terms and conditions of the Compromise Deed dated 23.01.2025 recorded before the learned Joint Registrar (judicial) on 06.02.2025, the FIR No. 0029/2025 dated 17.01.2025 registered at Police Station Dwarka, Delhi for the offences punishable under Section 420/468/471/120B of the IPC and all consequential proceedings emanating therefrom are quashed. 6.
The present petition stands disposed of.
