Petitioners are plaintiffs in a suit filed by them whereby they seek partition.

During the pendency of the abovesaid suit, an application moved under Order I Rule 10 CPC was allowed vide order dated 09.11.2016 and one Sh. Sumit Rajpal (son of the defendant) was impleaded as defendant in the abovesaid suit.

Such order is under challenge.

However, at the very outset, it is submitted from the side of petitioners that, without prejudice to their rights and contentions, petitioners are no longer interested in pursuing with the present petition and, therefore, they pray that the present petition may be dismissed as not pressed.
