Petitioner seeks quashing of FIR No.24/2026 dated 13.01.2026, registered at P.S. Shahbad Dairy, for commission of offence under Section 329(4) of BNS (corresponding Section 448 IPC) 2.

Learned counsel for the petitioner submits that a civil suit is already pending adjudication and despite the fact that the documents pertaining to such civil suit were made available to the Investigating Agency, they are going ahead with the investigation and trying to usurp the jurisdiction of Civil Court.

Learned Addl. P.P. for the State appears on advance notice and submits that investigation is underway and all the documents would be appropriately considered and the investigation would be just and fair. 4.

In view of the above, at this stage, learned counsel for the petitioner does not press the present petition.
