Petitioner is defending a civil suit and is aggrieved by dismissal of his application whereby he was seeking amendment in the written statement. 2.
While dismissing such application, learned Trial Court had also burdened the defendant with a cost of Rs. 25,000/-. 3.
Learned counsel for petitioners submits that the matter is already at the stage of trial and as per instructions, the petitioners are no longer interested in pursuing with the present petition and, therefore, the present petition may be disposed of, accordingly.

He, however, supplements that when the present petition was entertained by this Court, this Court had directed that the learned Trial Court shall not insist for payment of cost and such order is still in operation. He submits that the abovesaid cost may, therefore, be directed to be waived. 5.
None appeared from the side of respondent when the matter was called and taken up.

Be that as it may, in view of the abovesaid statement made by Mr. Aggarwal, learned counsel for petitioner, the present petition is disposed of as not pressed and simultaneously, the cost, which had been imposed on defendant vide order dated 31.01.2023, is directed to be waived. 7.
However, this Court expects that the defendants would render due assistance and cooperation to the learned Trial Court so that the Court is in a position to dispose of the suit in question, as expeditiously as possible. 8.
Present petition is disposed of as not pressed. 9.
Pending application also stands disposed of.
