The petitioner seeks expunction of remarks in the second and third paragraphs of order dated 16.10.2025 passed by the learned Special Judge, NDPS Act.

At the outset, learned counsel for petitioner submits that the anguish expressed by the learned Special Judge in the remaining part of order dated 16.10.2025 is not unjustified. But learned counsel for petitioner further addresses at length that the Chief Commissioner Customs cannot be held liable for whatever happened at the grass root level because at that level, it is the Commissioner Customs, but he was not called for any explanation by the learned Special Court. However, it is also submitted by learned counsel that subsequent to order dated 16.10.2025, the petitioner filed an application and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the learned Special Judge revoked the bailable warrants. 3.

I find substance in the submission fairly made by learned counsel for petitioner.

However, after addressing partly, learned counsel for petitioner seeks permission to withdraw this petition with liberty to move formal application before the learned Special Judge for expunction of those remarks. Having heard learned counsel at length, I have no reason to suspect that if such application is moved, the same would not be considered in positive spirits by the learned Special Judge.

As requested, the petition and accompanying applications are disposed of as withdrawn with liberty as sought. Of course, if required, the petitioner shall also be at liberty to again approach this court.
