Petitioners seek quashing of case FIR No. 534/2024 of PS Prashant Vihar for offence under Section 74/75/79/351(2) BNS on the ground that the complainant de facto has compromised the disputes with the petitioners. 2.

Keeping in mind the obnoxious allegations of sexual abuse on the basis of which the subject FIR was registered, I do not find it a fit case to invoke inherent powers to quash the FIR. Learned counsel for petitioners submits that the FIR was falsely registered as a part of matrimonial dispute between the complainant de facto and petitioner no. 1. It is trite that in proceedings of the present nature, the court cannot conduct a mini trial. The allegations in the subject FIR are not the routine allegations of dowry torture etc. The allegations are serious charges of sexual misconduct against petitioner no. 2, who is brother in law of complainant de facto. Learned counsel appearing for ASC discloses that chargesheet has already been filed and the matter is listed for consideration of charges. 4.
