The present petition has been filed under Article 226 of the Constitution of India wherein, the Petitioner, who is a member of the Jain Cooperative Bank ('Bank') seeks appointment of a Returning Officer for holding the Managing Committee elections in the Respondent No.2 - Bank. 3.
The case of the Petitioner is that the term of the Managing Committee would be expiring on 14th May, 2025. Accordingly, various letters dated 7th October, 2024; 11th December, 2024; and 14th January, 2024 were written by the Bank to the Registrar of Cooperative Society ('RCS') seeking appointment of a Returning Officer, however the same was not done. Thus the present petition was filed.

In this petition, the only relief sought from the Court is to direct the RCS or the Managing Committee to appoint a Returning Officer for conducting elections. Returning Officer, this Court deems it appropriate to appoint a Returning Officer for conducting the elections.

Accordingly, Mr.
Mahesh Gupta (Retd.
DHJS) (Mobile No.
9910384727) is appointed as the Returning Officer. 6.
The Returning Officer shall conduct the elections in terms of the Delhi Co-operative Societies Act, 2003 read with the Delhi Co-operative Societies Rules, 2007 and the Bye-laws of the society. The election shall be completed by 31st July 2025.

Let a copy of the Bye-laws be supplied to the Returning Officer by the Managing Committee of the society within one week. 8.
The present petition is disposed of. Pending application(s), if any, also stand disposed of.
